General Terms and Conditions (GTC) of Seasons Stories GmbH

1. Scope

These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the website thoughtsofseptember.

The offer is aimed exclusively atconsumers residing in Switzerland and Europe (hereinafter referred to as "customer").

A consumer is defined as a natural person who enters into a business relationship with Seasons Stories GmbH and is not acting in the course of a commercial or self-employed professional activity. Orders in quantities that are not typical for a household may be rejected without justification.

Seasons Stories GmbH reserves the right to change these Terms and Conditions at any time. The version of the Terms and Conditions valid at the time of ordering shall be decisive.

2. Information on this website

Thoughts of September endeavors to provide accurate, complete, and up-to-date information on its website. However, all product descriptions, images, technical details, weight specifications, prices, and other information are non-binding and subject to change at any time.

All offers are subject to change and do not constitute a binding offer. We reserve the right to make changes to the product range, prices, and delivery terms at any time.

3. Prices

All prices on thoughtsofseptember are quoted in Swiss francs (CHF) and include statutory value added tax (VAT), unless otherwise stated.

Shipping costs are calculated separately and clearly displayed during the ordering process.

4. Conclusion of contract

By submitting the order,thecustomer makes a binding offer to purchase the selected products. After the order is received, the customer will receivean automatic confirmation of receipt by email. This does not yet constitute acceptance of the purchase offer.

The purchase contract only comes into effect upon express acceptance by Thoughts of September , which is made by means of a shipping confirmation via email.

5. Payment options & retention of title

The following payment options are available:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Twint
  • Purchase on account with POWERPAY

When paying by invoice, the customer will receive a separate monthly invoice from POWERPAY. In this case, the terms and conditions of POWERPAY also apply.

Until full payment has been received, the goods remain the property of Thoughts of September.

6. Delivery & Shipping Terms

Delivery will be made by mail or courier to the address provided by the customer.

Delivery times are approximate and not binding. Thoughts of September is not liable for delays caused by transport service providers.

If the goods cannot be delivered or if acceptance is refused, the customer shall bear the additional costs for reshipment.

7. Right of withdrawal & returns

Returns:
The goods must be returned within 10 days in their original packaging and unused. The customer is responsible for the shipping costs for returns.

Eine Rückerstattung erfolgt innerhalb von 20 Kalendertagen nach Erhalt der Rücksendung.

Damaged Goods

If any item is damaged upon delivery, you must document the damage with a photo immediately upon receipt of the goods, report it, and return the item without delay. 

Dirty Parts

Für Retouren, die verschmutzt bei uns eintreffen, erheben wir eine Reinigungsgebühr von CHF 15.- pro Stück.

Exchange

Sofern sich die Produkte im Originalzustand befinden, sowie ungetragen sind und wir die Artikel noch in unserem Sortiment führen, bieten wir jederzeit einen Umtausch an. Sende die Artikel einfach an untenstehende Adresse und schreib dazu, welche Grösse wir dir stattdessen senden sollen.

Kosten Retoure

Der Umtausch von Artikeln sowie reguläre Retouren sind für dich kostenlos.

Ausnahmen für reine Retouren (ohne Umtausch):
Da wir all unsere Produkte auf Bestellung produzieren, berechnen wir bei grossen Retouren eine Bearbeitungsgebühr. Wenn du Artikel ohne Umtausch zurücksendest, verrechnen wir folgende Gebühren sowie die Versandkosten:
  • Bei einer Retoure von 60% bis 90% des Bestellwerts: Wir verrechnen eine Gebühr von 10% des Werts der retournierten Ware.
  • Bei einer Retoure von über 90% des Bestellwerts: Wir verrechnen eine Gebühr von 20% des Werts der retournierten Ware.
  • Bei einer Retoure ab 400.- wird der Betrag in Form eines Gutscheins erstattet.

Exceptions to the right of withdrawal:

  • Opened or worn lingerie (for hygienic reasons)
  • Goods that have been customized to individual customer requirements
  • Digitale Inhalte oder Gutschein

8. Terms and conditions for workshops and events

Registration & cancellation by participants:

  • Registration is binding and obligates you to pay.
  • Cancellations must be made in writing.

Cancellation fees:

  • Up to 14 days before the workshop: 50% of the participation fee
  • Less than 7 days in advance: 100% of the participation fee
  • Cancellation less than 48 hours in advance or no-show: full fee payable

Illness & cancellation by the organizer:

  • In case of illness, a substitute may participate or a credit for a later workshop may be issued (upon presentation of a medical certificate).
  • In case Thoughts of September cancels the workshop, the participation fee will be refunded in full or a rebooking will be offered.

9. Warranty & Notice of Defects

The statutory warranty period is two years from the date of delivery.

Notice of defects:

  • Customers must report visible defects immediately upon receipt of the goods.
  • Returns are made at the customer's risk.

The following are excluded from the warranty:

  • Normal wear and tear
  • Improper use
  • Consumable & wear parts

Thoughts of September decides whether to repair, replace, or refund.

10. Disclaimer

Thoughts of September excludes any liability for damages arising from the use of the website or from delays, errors, or failures.

Similarly, no responsibility is assumed for the content of linked websites.

Statutory liability applies in cases of gross negligence or intentional damage.

11. Data protection

The data protection provisions can be viewed in the separate privacy policy.

Thoughts of September processes customer data for order processing and marketing purposes. Data is only passed on to third parties to the extent necessary (e.g., payment or shipping service providers).

Customers have the right to object to the use of their data for marketing purposes.

12. Final provisions

Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

Swiss law applies exclusively.
