General Terms and Conditions (GTC) of Seasons Stories GmbH

1. Scope

These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the website thoughtsofseptember .

The offer is aimed exclusively at consumers residing in Switzerland and Europe (hereinafter referred to as "customer ").

A consumer is defined as a natural person who enters into a business relationship with Seasons Stories GmbH and is not acting in the course of a commercial or self-employed professional activity. Orders in quantities exceeding typical household use may be refused without explanation.

Seasons Stories GmbH reserves the right to amend these Terms and Conditions at any time. The version of the Terms and Conditions valid at the time of the order shall apply.

2. Information on this website

Thoughts of September strives to provide accurate, complete, and up-to-date information on its website. However, all product descriptions, images, technical details, weight specifications, prices, and other information are non-binding and subject to change at any time.

All offers are subject to change without notice and do not constitute a binding offer. We reserve the right to make changes to our product range, prices, and delivery terms at any time.

3rd Prizes

All prices on thoughtsofseptember are in Swiss francs ( CHF Prices shown are ) and include statutory value added tax (VAT), unless otherwise stated.

Shipping costs are calculated separately and displayed transparently during the ordering process.

4. Conclusion of contract

By submitting the order, the customer makes a binding offer to purchase the selected products. After receiving the order, the customer will receive an automatic confirmation of receipt by email. This confirmation does not yet constitute acceptance of the purchase offer.

The purchase agreement only comes into effect with the express acceptance declaration from Thoughts of September , which is done by means of a shipping confirmation via e-mail.

5. Payment options & retention of title

The following payment options are available:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Twint
  • Purchase on account with POWERPAY

Customers paying by invoice will receive a separate monthly invoice from POWERPAY. In this case, POWERPAY 's terms and conditions also apply.

The goods remain the property of Thoughts of September until full payment is received.

6. Delivery & Shipping Conditions

Delivery is made by post or courier to the address provided by the customer.

The stated delivery times are estimates and not binding. Thoughts of September is not liable for delays caused by shipping providers.

If the goods cannot be delivered or if acceptance is refused, the customer will bear the additional costs for resending them.

7. Right of withdrawal & returns

Return:
The goods must be returned in their original packaging and unused within 10 days . Return shipping costs are the responsibility of the customer.

A refund will be issued within 20 calendar days of receiving the returned item.

Damaged goods

If any part is damaged upon delivery, these defects must be documented with a photo immediately upon receipt of the goods, reported and returned without delay. 

Contaminated parts

For returned items that arrive dirty, we charge a cleaning fee of CHF 15.- each.

Provided the products are in their original condition, unworn, and still in stock, we offer an exchange at any time. Simply send the items to the address below and specify which size you would like us to send you instead.

Return shipping costs

Exchanging items and making regular returns are free of charge for you.

Exceptions for returns only (without exchange):
Since we produce all our products to order, we charge a processing fee for large returns. If you return items without exchanging them, we will charge the following fees in addition to the shipping costs:
  • For returns of 60% to 90% of the order value: We charge a fee of 10% of the value of the returned goods .
  • For returns exceeding 90% of the order value: We charge a fee of 20% of the value of the returned goods .
  • For returns of 400.- or more, the amount will be refunded in the form of a voucher .

Exceptions to the right of withdrawal:

  • Opened or worn lingerie (for hygiene reasons)
  • Goods that were manufactured according to individual customer wishes
  • Digital content or voucher

8. Terms and Conditions for Workshops & Events

Registration & cancellation by participants:

  • Registration is binding and obligates payment.
  • Cancellations must be made in writing.

Cancellation fees:

  • Up to 14 days before the workshop: 50% of the participation fee
  • Less than 7 days prior: 100% of the participation fee
  • Cancellation less than 48 hours in advance or no-show: full fee owed.

Illness & cancellation by organizer:

  • In case of illness, a substitute can participate or a credit can be issued for a later workshop (upon presentation of a medical certificate).
  • If Thoughts of September cancels the workshop, the participation fee will be fully refunded or a rebooking will be offered.

9. Warranty & Notification of Defects

The statutory warranty period is two years from the date of delivery .

Complaint:

  • Customers must report any visible defects immediately upon receiving the goods.
  • Returns are at the customer's risk.

The following are excluded from the warranty:

  • Normal wear and tear
  • Improper use
  • Consumables & Wear Parts

Thoughts of September decides whether a repair, replacement, or refund will be provided.

10. Disclaimer

Thoughts of September excludes all liability for damages arising from the use of the website or from delays, errors or failures.

Likewise, no responsibility is assumed for the content of linked websites.

For gross negligence or intentional damage, statutory liability applies.

11. Data Protection

The data protection regulations can be viewed in the separate privacy policy .

Thoughts of September processes customer data for order fulfillment and marketing purposes. Data is only shared with third parties to the extent necessary (e.g., payment or shipping providers).

Customers have the right to object to the use of their data for marketing purposes.

12. Final Provisions

Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.

Swiss law applies exclusively .
